Remy Ma wants out of jail. The rapper's attorney filed an appeal requesting to have the eight year prison sentence Remy got tagged, dropped. TMZ is reporting that Remy's lawyer says there are various flaws in her recent trial where she was charged and placed behind bars for shooting Makeda Barnes-Joseph.
Remy's lawyer said "THE TRIAL COURT'S ORDER FORBIDDING DEFENSE COUNSEL FROM ARGUING DURING SUMMATION THAT MAKEDA JOSEPH WAS SHOT DURING A STRUGGLE FOR THE GUN DENIED MS. SMITH A FAIR TRIAL, MS. SMITH WAS UNFAIRLY PREJUDICED BY THE INCLUSION IN THE INDICTMENT OF THE COUNTS REGARDING THE VIOLENT GANG ASSAULT AT THE PLAYER'S CLUB, AS TO WHICH THERE WAS NO EVIDENCE OF HER COMPLICITY, BUT WHICH LIKELY COLORED THE JURY'S CONSIDERATION OF THE REMAINING COUNTS."
Finishing up, Remy's lawyer said "THE GUN POSSESSION CHARGE MUST BE DISMISSED BECAUSE PENAL LAW 265.03 UNQUALIFIEDLY BANS THE POSSESSION OF HANDGUNS OUTSIDE THE HOME, OR PLACE OF BUSINESS AND IS THEREFORE UNCONSTITUTIONAL."
